§ 5-4. Merchandise tagged or labeled.

  • No person shall offer for sale or sell at public auction any articles of merchandise unless there is securely attached to each of such articles a tag or label upon which shall be plainly written or printed, in the English language, a true and correct statement of the kind, character and quality of such articles; and such tag or label attached to the article shall be delivered to the purchaser. It shall be deemed prima facie evidence of intent to defraud in case such written statement upon the tag or label is not a true and correct description and representation of such article sold.
